Introduction

Mr. Jaecheong Oh is a partner at Shin & Kim and his practice focuses on licensing and registration of financial companies, financial regulation, domestic and international investment (funds, REITs, etc.), fintech (e-finance), virtual assets, and M&As of financial companies.

Since joining Shin & Kim in 2015, Mr. Oh has worked in the Financial Regulation Group, Virtual Assets Practice Group, and Digital Finance Practice Group. He provides in-depth advice to meet our clients' needs for new businesses, products, and business models based on his extensive understanding of traditional financial regulations and diverse experience in handling a broad range of cases involving licensing, registration, advisory service, disputes, and response to regulatory authorities for clients ranging from traditional financial companies to virtual asset business operators, virtual asset-related project teams, fintech, e-finance, and big tech companies.

Mr. Oh graduated from Yonsei University College of Law, earned his J.D. from Yonsei University Law School, and his LL.M. from UC Berkeley School of Law. Mr. Oh currently serves as a delegate to the Korean Bar Association and a member of the International Committee of the Seoul Bar Association.

In addition, Mr. Oh is also an appointed lecturer at the Financial Investment Education Institute, where he lectures on the Capital Markets Act and the Company Act to executives and employees of the National Pension Service, the Korea Securities Depository, and various financial investment companies. He has also been recognized as a “Rising Star” in finance in 2023 by the Legal Times.

  • Registered Hyphen Corporation as an e-finance business (prepaid electronic payment apparatus issuance and management business, electronic payment settlement agency service business).
  • Advised Kendall Square REIT Management on licensing as an asset management company.
  • Registered a hedge fund investment business as an additional business for KR& Partners.
  • Advised Bank Negara Indonesia (BNI) on licensing of the establishment of a new branch in Seoul.

  • Advised JR Global REIT on licensing and deals in connection with its real estate investment in Belgium (Real Estate Deal of the Year, 2020).
  • Advised KIND on its Global Infrastructure Fund and Global Plant Construction Smart City Fund.
  • Advised ESR Kendall Square REIT on licensing and deals.
  • Advised IGIS Global REIT on licensing and deals.
  • Advised ESR Cayman Limited on Korean law and its subsidiary listing on the Hong Kong Stock Exchange.
  • Advised a Korean company on its direct listing on the Hong Kong Stock Exchange utilizing a Cayman Islands SPC (Precedent case, 2016).
  • Advised commercial banks, public institutions, and financial companies on the issuance of overseas bonds.
Criminal Cases, Disputes
  • Handled cases of unregistered foreign exchange transactions for about 30 financial investment companies (including the Financial Supervisory Service, prosecutors, and courts) (Obtained suspension of prosecution, suspension of indictment) (Judgment of acquittal in the first, second, and third trials).
  • Handled cases of unregistered foreign exchange transactions for electronic financial services companies (Obtained suspension of prosecution).
  • Responded to a case of unfair trade practices under the Capital Markets Act.
  • Responded to a criminal investigation against a Korean virtual asset exchange and its executives.
