Attorney Chang-Hun Lee delivered a presentation entitled “A Study on the Controversy over Excessive Royalties” at a seminar held by the Society of Economic Law Case Studies (SELCS). SELCS holds regular seminars attended by scholars and practitioners to discuss various competition law issues.
At the seminar, Mr. Lee addressed the controversial issue of patent holders’ imposition of excessive royalties which recently attracted the attention of the competition law community, with a focus on the dispute between Samsung Electronics and Apple (Seoul Central District Court Civil Division 2011GaHap39552 rendered on August 24, 2012). In his presentation, Mr. Lee emphasized that in practice, the determination of whether a royalty rate is excessive is not only technically impossible but also undesirable since it likely undermines incentives for cost reduction and innovation.
