Shin & Kim foreign attorney Arie Eernisse won the first runner-up prize in the second annual Young Singapore International Arbitration Centre Essay Competition. The prize was awarded at the Singapore International Arbitration Centre (SIAC) Congress 2016 in Singapore on May 27, 2016.
Mr. Eernisse’s essay explores the question of whether the new draft SIAC Investment Arbitration Rules (IA Rules) will provide a credible alternative to the dominant forms of investment arbitration, namely those governed by the rules of the International Centre for Settlement of Investment Disputes (ICSID) and the United Nations Commission on International Trade Law (UNCITRAL). Mr. Eernisse explains that, while the draft IA Rules provide for a substantially more efficient and progressive system of investment arbitration, they will only gain a foothold in the market if they are aggressively promoted for inclusion in bilateral investment treaties and free trade agreements, especially those involving Asian countries. The final version of the IA Rules is expected to be unveiled in September 2016.
